Terms & Conditions

These Terms & Conditions (“Terms”) form an agreement between you and Bofoh (“we”, “us”, “our”) and govern your access to and use of the Bofoh platform, including the website, listings, messaging and any related services (the “Service”). By creating an account or using the Service you agree to these Terms.

1. Trade-only eligibility

Bofoh is a technology enabled trading platform for hospitality businesses, suppliers, professionals and event organisers. By registering you confirm that you are at least 18 years old, that you are acting in the course of a trade, business or profession, and that the information you provide is accurate. We may verify your trade status and decline or remove accounts that do not meet our eligibility criteria.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorised access. We may suspend or terminate accounts that breach these Terms.

3. Listings and content

You retain ownership of the content you submit (listings, descriptions, images, messages). By submitting content you grant Bofoh a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content for the purpose of operating and promoting the Service.

You confirm that your content is accurate, that you have the rights needed to post it, and that it does not infringe the rights of others or break any law. We may edit, remove or refuse listings at our discretion, for example where content is misleading, offensive, duplicative, or outside our trade scope.

4. Acceptable use

You agree not to:

• Use the Service for anything other than legitimate hospitality trade activity.
• Post unlawful, defamatory, harassing, misleading or discriminatory content.
• Scrape, harvest, copy or otherwise extract platform data, listings or member contact details for use outside Bofoh.
• Send unsolicited marketing, spam or content unrelated to the hospitality trade to other members.
• Attempt to disrupt the Service, bypass security, or interfere with the experience of other members.
• Impersonate any person or business, or misrepresent your affiliation with one.

5. Off-platform dealings

Bofoh introduces members; commercial dealings (supply, hire, attendance at events) are between the members themselves. We are not a party to those transactions and are not responsible for the quality, safety, legality or delivery of goods or services arranged through the platform. Members are responsible for carrying out their own due diligence.

6. Fees

Current fees and plans are published on our pricing page. Any changes to fees will be communicated clearly before they apply to your account, and you may cancel paid plans at any time.

7. Intellectual property

The Bofoh name, brand, logo and all platform software, design and content (excluding member-submitted content) belong to Bofoh and are protected by intellectual property laws. You may not copy, modify or use them without our prior written permission.

8. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

9. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms, if your trade eligibility cannot be verified, or if we discontinue the Service. On termination, the licences you have granted us in respect of content already published may continue for the period needed to operate and archive the Service.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or that listings or members are accurate, reliable or suitable for your purpose.

11. Liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited under applicable law.

Subject to that, to the fullest extent permitted by law, Bofoh shall not be liable for any loss of profit, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss arising out of or in connection with the Service. Our total liability arising in connection with these Terms in any 12-month period shall not exceed £100.

12. Changes to these Terms

We may update these Terms from time to time. Where changes are material we will notify you through the platform or by email. By continuing to use the Service after changes take effect you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
